These Terms of Service govern access to https://theelsearchive.com and use of the online services provided by BRANCHIO LLC, doing business as THE ELSE ARCHIVE. By using the site, the user agrees to these terms and the policies incorporated by reference.
Eligibility and Accounts
Users must be able to enter a binding contract under applicable law. Account information must be accurate and kept secure. The account holder is responsible for activity performed through the account, except where applicable law provides otherwise.
Store Information and Availability
We work to keep product descriptions, prices and availability accurate. Display colors and scale can vary by device. Inventory may change without notice, and we may limit quantities or discontinue products. These rights do not allow us to alter a completed order without the customer’s agreement.
Orders
An order is an offer to purchase. We may accept, reject or cancel an order for legitimate reasons, including unavailable stock, pricing or description errors, payment failure, suspected fraud, shipping restrictions or quantity limits. If we cancel a paid order, we refund the amount charged for the canceled item or order.
User Conduct
Users may not misuse the site, interfere with security, introduce harmful code, scrape the site without permission, attempt unauthorized access, violate another person’s rights, submit unlawful or misleading content, or use the services for fraud or illegal activity.
Customer Content
If a customer submits a review, photograph, comment or other content, the customer confirms that the submission is lawful and does not violate another person’s rights. The customer grants us a non-exclusive, worldwide, royalty-free license to use, reproduce and display the submission for store operation and promotion, subject to applicable privacy law. We may remove content that violates these terms.
Third-Party Services and Links
The store relies on third-party services such as Shopify, payment providers and carriers. We are not responsible for independent third-party websites or services, except to the extent applicable law makes us responsible. Use of third-party services may be subject to separate terms.
Intellectual Property
The site, brand names, product names, written content, graphics, photographs and designs are owned by or licensed to BRANCHIO LLC and are protected by applicable intellectual property laws. Limited personal use of the site does not transfer ownership or grant commercial reproduction rights.
Disclaimer of Warranties
To the fullest extent permitted by law, the site and online services are provided on an “as available” basis. We do not warrant uninterrupted access or that every error will be corrected. Products remain subject to any express description or warranty stated on the product page and to rights that cannot be excluded under applicable law.
Limitation of Liability
To the fullest extent permitted by law, BRANCHIO LLC and its owners, employees and service providers will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the site. For a claim relating to a purchase, our aggregate liability will not exceed the amount paid for the product giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
Indemnification
To the extent permitted by law, a user agrees to indemnify BRANCHIO LLC against third-party claims arising from the user’s unlawful misuse of the site, violation of these terms or infringement of another person’s rights. This provision does not apply to claims caused by our own unlawful conduct.
Governing Law
These terms are governed by the laws of the State of Missouri and applicable federal law, without regard to conflict-of-law rules. Consumers retain any mandatory rights and venue protections provided by the law of their residence.
Changes Severability and Entire Agreement
We may update these terms by posting a revised version with a new effective date. If a provision is found unenforceable, the remaining provisions continue in effect. These terms, the Terms of Sale and the policies referenced at checkout form the agreement governing use of the store.
